Fixed Fee Services – Terms and Conditions

At Arkspace Architects, we offer a Fixed Fee service for specific project types, providing transparency and clarity in our pricing. Our Fixed Fee services are subject to the following terms and conditions:

1) Fixed Fee Validation

The fixed fee proposal from Arkspace Architects is valid for a period of 60 days from the date of submission.

2) Project Pause and Restart Policy

If a client chooses to pause a project after completing a specific stage and resume work in the following calendar year, the fee will be subject to review and potential revision. This ensures alignment with updated market conditions and expectations in the construction industry.

3) Scope of Work
The Fixed Fee is applicable only to the defined scope of work agreed upon between the client and Arkspace Architects. Any changes or additions to the original scope may result in an adjustment to the fixed fee. Additional services outside the agreed scope will be charged separately.

4) Project Stages
The Fixed Fee covers the agreed-upon phases of the project, including design, documentation, and necessary revisions. The submission of the documents of each project stages to client will signify the completion of the Design Stage services scope of works. Any changes that made post completion stage may result variation fees.

Note: Fixed fee is not applicable to Development Approval Stage.

5) Payment Terms
Payment for Fixed Fee services will be structured as follows:

    • An initial deposit per project stages is required upon signing the agreement.

    • The final payment is due upon completion of the project stages or delivery of services, as specified in the agreement.

6) Client Responsibilities
The client is responsible for providing all necessary information, approvals, and decisions in a timely manner to avoid delays in the project timeline. Any delays in client feedback or approvals may result in project timeline extensions and additional costs.

7) Exclusions
The Fixed Fee does not include services such as engineering, structural design, permits, or any third-party fees unless explicitly stated in the agreement. These costs are the client’s responsibility.

8) Changes in Project Requirements
Any significant changes to the project after the initial agreement may require a re-evaluation of the Fixed Fee. This will be discussed and agreed upon by both parties before proceeding.

9) Termination or Suspension
In the event that the client wishes to suspend or terminate the project, a written notice must be provided. If the project is terminated before completion, the client will be invoiced for work completed up to the termination date.

10) Legal Compliance
Both parties agree to comply with all local laws, building regulations, and zoning requirements. Any necessary adjustments to the design or services due to regulatory changes may incur additional fees.

11) Dispute Resolution
Any disputes related to the Fixed Fee agreement will be handled through direct communication. If a resolution cannot be reached, both parties agree to engage in a mutually agreed-upon mediation process before seeking legal action.

By accepting our Fixed Fee service, the client acknowledges and agrees to the terms and conditions outlined above.
